As for Ms. Grijalva, she is not the first to remain congressional-elect to remain unseated for a period. There were those who were never seated including Pinckney Pinchback\, elected senator from La. in 1872, but never was permitted to take his seat in the Senate and of course in 1877, after republican president Hayes gave the entire republican-elect government to the Democrats, they withdrew. Pinchback's elections.

Now most commentators mention the contested election, but by my count Pinch back remained unable to take his seat for four years before that Contested election (not that the white Democrats in Louisiana had not contested every reconstruction era election).

This instability our government is operating within, while shaky and nearly impossible to work with, is probably another intentional ploy to give Trump even more excuses for abusive power. The claims he makes are incredibly outrageous, and his ability to flip-flop enable him to claim β€œlaw and order!” if it serves his purposes yet throwing out laws and the constitution when that serves him better. The title of the recent Atlantic article by Tom Nichols says it so well: β€œA Confederacy of Toddlers: The Trump administration is a Regime of Troubled Children.”
